Informant: Mr J McLaughlin, stipendiary steward
Defendant Mr J Misbah, licensed jockey
Mr Misbah admitted a breach of R 638(2) in that he made a celebratory gesture when winning race 8 on CHAPARELLA.
--The stipendiary steward demonstrated on the video that the defendant stood up in his irons and waved his whip. The gesture was 2 to 2 1/2 strides before the finishing line.
--Mr Misbah asked us to consider that CHAPARELLA was his first winner in a listed race. He had never previously been in breach of this Rule.
--Mr McLaughlin asked for a fine in the vicinity of $200. Having regard to the defendant’s admission of the breach and his good record, we believe the matter can be dealt with by way of a fine of $200. Mr Misbah was reminded of his obligations under the Rules of Racing.
