Stipendiary Steward, Mr P Knowles, alleged that "with approximately 30 metres to race ELEGANT EMMA (AJ Suddaby) moved outwards onto JACKA KORU (BD McLellan) causing that horse to break."

DECISION AND REASONS:
--Stipendiary Steward, Mr P Knowles, alleged that "with approximately 30 metres to race ELEGANT EMMA (AJ Suddaby) moved outwards onto JACKA KORU (BD McLellan) causing that horse to break."
--Video evidence both side and front was shown. Just short of the line ELEGANT EMMA ducked out sharply and although there was no contact JACKA KORU subsequently broke.
--Margins were half a length and a nose. The photo finish was produced confirming it was a bare nose margin from second to third.
--Mr Suddaby said the JACKA KORU paced for about 10 metres after the incident and Mr Toomey (Owner of ELEGANT EMMA) said it broke "right on the line."
--McLellan in evidence said he would not have won but his horse was finishing well with a good chance of finishing second. He said, "I grabbed hold of him just short of the line."
--Decision:
--I am convinced that ELEGANT EMMA running out caused the other horse to break. Also that JACKA KORU would have finished second but for the interference. I am also convinced that the break was totally caused by ELEGANT EMMA ducking out sharply as the horse was running strongly when it occurred and no other horse was involved.
--I therefore relegate No.3, ELEGANT EMMA to third and promote No.12, JACKA KORU to second, and No.4, DREAM A LITTLE, to first.
