Decision:

Following the running of Race 2 B Weaver the driver of Canterbury Dash was charged with a breach of Rule 869 (3)(b) ? Careless driving.



Following the running of Race 2 B Weaver the driver of Canterbury Dash was charged with a breach of Rule 869 (3)(b) ? Careless driving.

It was alleged that shortly after the start Mr Weaver allowed Canterbury Dash to move inwards which resulted in Copper Creek and Paulina Jay being checked.

--

Copper Creek also breaking as a result of the check.

--

Mr Weaver admitted the breach.

PENALTY

--

Prior to hearing submissions on penalty the committee were shown the films of the incident. Mr Weaver's record was also produced which demonstrated no previous charges under this rule.

Mr Escott, when making his submissions, stated that this matter would be best dealt with by way of a fine, however if Mr Weaver was not in a position to pay such a fine that then a modest suspension should be imposed.

Mr Weaver, after questioning from the Chairman, stated that he would prefer a suspension and as such enquires were made as to his forthcoming driving engagements.

--

We find, after considering submissions, that the matter is best dealt with by way of a period of suspension and when determining the quantum of such we have given Mr Weaver credit for his admission of the breach and credit also his clear record to date.

--

We acknowledge that the movement was not significant nevertheless interference has occurred and a runner has lost considerable ground as a consequence of this.

--

Therefore after carefully considering the submissions of both parties it is the finding of this committee that Mr Weaver's horseman's licence be suspended from the close of racing today up to and including racing on Saturday the 7th of May.
