Decision:

Following the running of Race 8, the Postponed Classis Group 3 over 1400 metres, Mr. B.Lammas was charged with careless riding under Rule 638 (1) (d).

Following the running of Race 8, the Postponed Classis Group 3 over 1400 metres, Mr. B.Lammas was charged with careless riding under Rule 638 (1) (d).

The information alleged that B.Lammas the rider of O’CEIRINS ANGEL allowed his mount to shift inward near the 1100 metres when not clear of CULMINATE causing tightening to that runner.

Mr. Lammas admitted the breach.

Mr. Goodwin identified the horses involved and explained the incident using the available videos. He asked the committee to ignore additional interference to inside runners because Mr. Lammas had not contributed to this.  CULMINATE ridden by Mr. L. Innes had her line of running dictated to by Mr. Lammas when he crossed in front of her when not the required distance clear. This caused Mr. Innes to take hold of his mount and as he did so he was pushed up against IL QUELLO VELOCE to his inside.  It was estimated that Mr. Lammas was only 1 ½ lengths clear when he crossed in front of CULMINATE.

Mr. Lammas said that he thought he had been clear when he crossed as Mr. Innes had not called out to him. Upon viewing the videos he conceded that he hadn’t been quite clear but he believed that CULMINATE was over-racing prior to him dictating her line of running which contributed to the interference.

Mr. Neal told the committee that Mr. Lammas has an excellent record with only one suspension for careless riding in the past 12 months.  The stewards’ opinion was that this incident was at the lower end of the scale however it did occur in a Group 3 race with a stake of $80,000 therefore a suspension of five or six days and a monetary penalty be imposed.

Mr. Lammas said that he did not have any riding engagements within the next seven days therefore any suspension could begin immediately.

Penalty

In coming to a decision on penalty the committee took into account all of the submissions put before us including Mr. Lammas’s admission of the breach and his excellent riding record. It has been usual practice to impose harsher penalties in “black-type” races therefore we had regard to the status and stake of the race being a Group 3 event worth $80,000.
In setting today’s penalty we were mindful of other breaches in Group  races however Mr. Neal did say that the Stewards are not seeking the same level of penalties now as they were a year or two ago.

We agreed that this particular breach sat at the lower end of carelessness and it occurred at a stage of the race where the only horse affected, CULMINATE, did have time to recover from the interference.

--

For all of these reasons we impose a six day suspension with a monetary penalty of $600.00.  Acknowledging that Mr. Lammas rides throughout the country he is suspended from the conclusion of racing today, October 10th until the conclusion of racing on Wednesday October 21st 2009.
