Mr DR Bothamley was charged with a breach of Rule 520 (4)(c) in that he failed to make the contracted weight on two mounts in Races 2 and 9



Mr DR Bothamley was charged with a breach of Rule 520 (4)(c) in that he failed to make the contracted weight on two mounts in Races 2 and 9 at the Canterbury Jockey Club’s meeting on 6th October 2007.

Mr Bothamley pleaded guilty to the charge which is therefore deemed to be proved.

Mr Ching told the hearing that Mr Bothamley contacted him at 9 am today and advised him that he was struggling to make the weight he had contracted to ride. The weight that he could achieve was 1¼ kilogrammes over the carded weight. Mr Bothamley told us that he had ridden at 54½ kilogrammes at Ashburton one week ago and that he had been working hard during the week on maintaining his weight.

PENALTY DECISION

In so far as penalty is concerned, Mr Ching observed that Mr Bothamley had notified him of his weight problem early in the day, and that he pleaded guilty at the earliest opportunity. It is also the first time that Mr Bothamley has been charged pursuant to this Rule. Mr Ching recommended a monetary penalty. Mr Bothamley had no submissions to make on penalty.

The starting point, Mr Bothamley, for a first offence pursuant to this Rule is, in our view, a fine of $300. However, we take into account that you notified Mr Ching of your problem early in the day so that the inconvenience to the trainers of the horses that you had contracted to ride was minimised.

We also noted a mitigating factor that you have made genuine efforts to make the weight by exercising and spending time in the sauna. After taking those mitigating factors into account, we set the fine at $250.
