Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendiary Steward J Oatham that Mr T Harris had shifted out on HAMLETS GHOST when not sufficiently clear

DECISION & REASON:

--

Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Stipendiary Steward J Oatham that Mr T Harris had shifted out on HAMLETS GHOST when not sufficiently clear dictating the line of SKEETA and FAALCON and causing a sharp check to SKEETA near the 100 metres. Mr Harris was represented by Mr A Carston.

Mr Bosson and Mr Taylor confirmed their evidence that they had given in the previous hearing which resulted in HAMLETS GHOST being relegated from first to fourth, Mr Bosson stating that he was squeezed out then had to pull off the heels of HAMLETS GHOST as his line was taken.

Mr Taylor confirmed that he had received pressure from the inside all the way down the straight until he finished near the outside rail.

Mr W Robinson, in demonstrating the video claimed that Mr Harris, while using his whip on the outside to ostensibly keep the horse straight, however he did nothing with the inside rein to straighten the horse up. He pointed out that at no time did the horse's head appear to turn in to straighten the horse up and therefore take the pressure off the outside horses.

Mr Harris and Mr Carston both claimed that the horse was a difficult ride and all efforts had been made to keep it on a straight line.

In summing up Mr Oatham repeated Mr Robinson's earlier observations and said that the outward movement was about 15 horses equivalent.

The Committee, after reviewing all the evidence, concluded that they preferred the evidence of Mr Oatham and his witnesses, accordingly find Mr Harris guilty as charged.

PENALTY:

--

Mr Oatham gave Mr Harris' good record but asked for a suspension.

--

Mr Harris, when asked, said that he rode all over the whole country.

--

--

In considering penalty the Committee have taken all submissions into account. In coming to their decision they have considered the severity of the offence and the consequences of the interference affecting two horses and the subsequent relegation of Mr Harris' mount from first to fourth.

--

Accordingly we suspend him from the conclusion of racing on 1 January until the conclusion of racing on 11 January 2007.
