Mr JS Bullard has been charged pursuant to Rule 520 (4)(c) in that he wilfully or without reasonable cause permitted himself to be engaged to ride horses at the Ashburton Racing Club's meeting on Sunday 3 September at a weight which the various horses were handicapped to carry and which he agreed to ride at. It seems that Mr Bullard is 1 to 1? kilograms over the weight. Mr Bullard admitted the charge and it is therefore proved accordingly.

PENALTY DECISION

--

In considering the penalty, we have taken into account the fact that the racing public and the connections of the various horses have depended on Mr Bullard's skills as the South Island's leading jockey. They no longer have Mr Bullard's skills available to them today. That is an aggravating feature that we must take into account. On the other hand, we recognise that Mr Bullard did have a busy riding day yesterday at Hawkes Bay, that he didn?t have access to a sauna in terms of the time between the conclusion of his engagements yesterday and the commencement of his engagements today. We also take into account that Mr Bullard is a well respected and skilful rider and that he has approached the problems that he has had with weight in the past responsibly. We are able to take those matters into account as mitigating features. A fine on this occasion is the appropriate penalty. We also bear in mind that Mr Bullard, as a consequence of this, has lost riding fees.
