DECISION AND REASONS:

Following the running of Race 8, the Stoney Bridge Rating 80, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging careless riding by Jockey L. M. Robinson.

Mr Robinson had indicated on the information that he admitted this breach of this Rules, and he confirmed this at the hearing. Mr Robinson also acknowledged that he understood the Rule and the charge.

Mr Ching illustrated this incident by means of video coverage, and showed that Mr Robinson had moved outwards as described in the information. It was seen that Mr Robinson’s movement outwards had continued over some distance over about the final 100 metres of the race, and that he had ridden his horse with vigour and had made little attempt to straighten his mount. The outcome was that he caused interference to the horses on his outside, with the worst affected being the 5th horse "Maruia Springs" which had been severely checked and lost a chance of finishing in a better placing.

Mr Robinson said that he thought that the horse on the very outside may have contributed to this incident by moving inwards very slightly. This was discussed but in our view any movement by the outside horse was negligible.

PENALTY:

In relation to penalty Mr Ching advised that Mr Robinson should be given credit for his guilty plea. However he has had two suspensions for careless riding in the last 12 months. These were a two day suspension on 11 March and a two day suspension on 5 May this year. Mr Ching said he believed the interference was in the mid to high range, and that rider safety was also an issue. Mr Ching also emphasised that the 5th horse, "Maruia Springs", could not protest under the Rules, and that it had very likely been denied the chance to finish in a better place.

Mr Ching recommended a suspension of between 4 – 8 days.

Mr Robinson said that his horse was green and contributed to the interference.

It was confirmed that Mr Robinson confined his riding to the South Island at this time of year. It was also discussed whether Mr Robinson wanted to avail himself of the "7 day rule" which allowed for a delay to the start of a suspension. This rule would enable Mr Robinson to continue riding up to and including Saturday 28 December 2007. Mr Robinson confirmed that he would like his suspension delayed.

We adjourned to consider the matter of penalty.

DECISION ON PENALTY:

In considering an appropriate penalty we have taken into account Mr Robinson’s guilty plea as being to his credit. There were several aggravating factors, as follows.

    • The breach was in the mid to high range of seriousness, and rider safety was an issue.
    • --
    • "Maruia Springs" received severe interference which affected its chances of finishing in a better place. Had this horse finished 4th or better instead of 5th there is no doubt that Mr Robinson’s horse would have been relegated.

    • Mr Robinson’s two previous convictions for careless riding within the last 12 months.
    • --
    • Mr Robinson made little or no effort to straighten his horse after it started to run outwards.

Taking all these matters into account we decided that a suspension was the only appropriate penalty in this case. This suspension is to commence on 29 December 2007 and is to end on 9 January 2008, both dates inclusive. This is a 5 day suspension.
