Under Rule 876 (1) Mr D Hollinshead, trainer of BELLAFORTE, ridden by apprentice Miss D Johnson, placed 4th by the judge, filed a protest against the 2nd placed horse ADORN



Under Rule 876 (1) Mr D Hollinshead, trainer of BELLAFORTE, ridden by apprentice Miss D Johnson, placed 4th by the judge, filed a protest against the 2nd placed horse ADORN ridden by apprentice Ms S Spratt and trained by D Logan & C Gibbs.

Mr Hollinshead stated that entering the straight ADORN shifted in and caused BELLAFORTE to be checked for 5 - 6 strides after the contact that was made. Stipendiary Steward Mr Oatham informed all present that the margin between the 3rd and 4th horses was a length and a half. Mr Hollinshead said his horse was a one paced horse.

Miss D Johnson said that her mount was checked for 3 - 4 strides losing momentum and took a bit to get going again, chances of finishing in a better position were affected.

Ms S Spratt demonstrated the incident on the video stating that she was entitled to her line entering the straight and was run into by BELLAFORTE who hit her flank and her mount was spun into BELLAFORTE which accentuated the incident. Mr Tait agreed with the evidence of his rider.

Stipendiary Steward Mr Coles made comment that the initial contact made by BELLAFORTE had turned ADORN around who then drifted in for several strides and made contact with BELLAFORTE and the panel had to decide whether the part played in the incident was enough to affect the margin of a length and a half.

The panel took these submissions into consideration including viewing the video replay of the incident and in reaching a decision noted that although there was some interference by ADORN, that BELLAFORTE was involved initially in the contact. Also considered was the margin between the 3rd and 4th horses of a length and a half.

It is our considered opinion that ADORN should not be relegated. The protest is dismissed and we order that the protest deposit be refunded.
