After race 5 Mr Knowles, stipendiary steward, instigated a protest into the 3rd placing of FRANCO SMOOTHIE alleging that with approximately 1400 metres to run FRANCO SMOOTHIE, driven by Mr S P Walkinshaw, moved outwards forcing WALK THIS WAY to race wider on the track.

After race 5 Mr Knowles, stipendiary steward, instigated a protest into the 3rd placing of FRANCO SMOOTHIE alleging that with approximately 1400 metres to run FRANCO SMOOTHIE, driven by Mr S P Walkinshaw, moved outwards forcing WALK THIS WAY to race wider on the track. He sought relegation to behind WALK THIS WAY which finished 4th. Judge's placings were 3, 12, 17, 16, 5, 14.
----Mr Knowles had Mr Allison, stipendiary steward, demonstrate on the video that with about 1400 metres to race WALK THIS WAY commenced a run 3 wide from near the rear. At this time Mr Walkinshaw, the driver of FRANCO SMOOTHIE decided to move out from the 2 wide line, thereby forcing Mr Jones from 3 to 4 wide. Unfortunately by the time FRANCO SMOOTHIE came out, the nose of WALK THIS WAY was clearly beyond the wheel of Mr Walkinshaw's cart, as both Mr Walkinshaw and Mr Negus, the trainer of FRANCO SMOOTHIE, have recognised. Mr Walkinshaw was thus in breach of the push out rule. As a consequence of this, Mr Jones was forced to race 3 wide for much of the remainder of the race. He was never able to take a position 2 wide outside the leader which he stated was his intention when he started his move from the back.
----We therefore find that the chances of WALK THIS WAY were affected by Mr Walkinshaw's breach of the push out rule. We exercise our discretion and relegate FRANCO SMOOTHIE to behind WALK THIS WAY. Amended placings are: 3, 12, 16, 17, 5, 14.
