DECISION AND REASON:

This an adjourned inquiry resulting from the Racing Rotorua race meeting held at Tauranga on the 4th of June 2008.

Information No.6124 was filed by Stipendiary Steward Mr A Coles pursuant to Rule 871(1)(d) – Careless Riding.     Mr Coles alleged that Ms S Spratt, the rider of RORY, permitted her mount to shift inwards near the 450 metre mark when not sufficiently clear of SIDEWINDER (C Lammas) who was forced into the line of MIGHTY SUN who clipped a heel.

Ms Spratt admitted the charge and was represented by her employer Mr R Yuill.

Mr Coles demonstrated the video films and showed where at the 450 metre mark Ms Spratt riding RORY allow her mount to roll in approximately one horse width and in doing so moved into the line of SIDEWINDER (C Lammas) who in turn was forced into the line of MIGHTY SUN.   This caused MIGHTY SUN to clip heels and dip as a result.

Mr Yuill in his statement said there was outward movement from the horse on the rails, which he believed contributed to the check received by MIGHTY SUN.

Ms Spratt stated she was rolling forward and had her horses head turned out to keep it straight.

Penalty Submissions:

--

Mr Yuill asked the committee to consider the following –

--

1.            No malice in Ms Spratt’s actions.

--

2.            Her guilty plea.

--

3.            It was a mid-week meeting.

--

4.            She is now getting advice from Mr R Vance and Mr T Williams reviewing race tapes.

--

5.            She is chasing the premiership.

--

Ms Spratt had nothing to add.

Mr George said Ms Spratt was careless in her actions in this instance and then produced her riding record showing five previous suspensions since January.   Accordingly he recommended a suspension of 3 to 5 weeks.

Penalty Decision:

--

The Chairman told Ms Spratt that the committee believed disappointment is the most descriptive way of explaining how they feel at her appearance before them again today.   I know I speak for the Stipendiary Stewards as well, when I say it gives us no pleasure at all having to repeatedly impose suspensions on your licence.

--

Having said that, safety in racing is paramount and therefore it is in your own interests and those of your fellow riders that this committee impose a penalty which protects those elements.  We have carefully considered all submissions made to us by Mr George, Mr Yuill and yourself.   We have reviewed the video films of the Tauranga charge and before imposing a penalty took into account the following –

--

1.            The degree of carelessness, and while we concede this was not at the higher end with your movement being relatively slight and only moving in one horse width, the repercussions could easily have been serious.

--

2.            Your riding record which obviously is of great concern to us.  It is appalling, showing eight suspensions since 11 August 2007, ranging from three days to one month and a $5000 fine.

--

3.            Your guilty plea, but your record tells us that you are not exercising due care at all times.

--

Accordingly, we impose a suspension to start after the conclusion of racing on the 18th June 2008 and conclude after racing on the 18th July 2008.

--

Ms Spratt, I hope you take this time out to reflect on why you have incurred these penalties and take remedies to resume your career in the manner which we know you are capable of.

--

We realise this is a tough penalty but one which we believe is necessary in the interests of all.   I think it is only fair to you to point out that if you do not rectify this record the JCA will have no option than a recommendation as to the future of your licence.   You are a very good rider and we all want to see you carry on your success in the future.
