Mr Escott, Chief stipendiary steward, alleged that at the New Zealand Metro Trotting Club Meeting on 7 October in race 6 Mr Kerr, trainer of ALTA SIROCCO, failed to affix the pull down blinds so as not to malfunction. He provided a signed approval from Mr Rennell, General Manager HRNZ, granting permission for an information under rule 864(2)(d) to be filed by Mr Escott pursuant to rules 1103(4)(c) and 216 (stipendiary stewards' reviewing powers).

Mr Kerr, your evidence is that you went to some considerable lengths to ensure that the blinds did operate on the night as Mr De Filippi had indicated to you that he had had difficulty with this particular gear on the previous occasion that he had driven ALTA SIROCCO. We accept your statement that you went to the garage and had the blinds adjusted, in that they were loosened, and that you tested them and found that they worked correctly. Mr Escott has acknowledged that you generally turn your horses out in a very satisfactory manner. We accept that this, together with your admission and the fact that this is your first breach of this rule, are mitigating factors.

Nonetheless, Mr Escott is right when he says that this was an important race with a stake of $30,000, on a premier night, and that the horse finished 2nd.

Balancing these matters, we impose a fine of $250 and remind you, should that be necessary, of your obligations under the Rules of Harness Racing.
