Decision: An information was filed instigating a protest following the running of race five. The informant was Mr.T.W.Taumanu and this was a protest by horse number 10, Dollars Bromac (Mr. G Smith) placed 9th by the judge against horse number 4, Mach Express ( Mr. L Hollis) placed 3rd
An information was filed instigating a protest following the running of race five. The informant was Mr.T.W.Taumanu and this was a protest by horse number 10, Dollars Bromac (Mr. G Smith) placed 9th by the judge against horse number 4, Mach Express ( Mr. L Hollis) placed 3rd by the judge on the grounds that horse number 4 Mach Express caused interference to Dollars Bromac in the last 120 meters and caused this runner to break from its gait. The judges placings for the race were 1st No 1, 2nd No 5, 3rd No 3, 4th No 11.5th No 6, 6th No 7.
--Present at the hearing of this information were Mr L Hollis driver/part trainer of Mach Express who represented the owners of this horse and Mr G Smith the driver of Dollars Bromac.
--Mr Taumanu opened his case by showing the video of the run home and this clearly showed Mach Express racing in a three back position in the running line come out for a run and when this runner came out the sulky of Mach Express touched the front legs of Dollars Bromac forcing this runner to break stride and gallop. Mr Taumanu stated that he observed Mach Express come out from his vantage point three stories up and with a full head of steam and Mach Express had touched the front legs of Dollars Bromac putting this runner off stride.
--Mr.G.Smith was asked by the Chairman why his horse had galloped and Mr.Smith replied it was because of the contact from Mach Express when this runner angled out for a run.
--Mr.Hollis gave his interpretation of the video and admitted he came out in a quick manner however he did not agree it was entirely his fault Mr. Hollis believed that Speedstar driven by Mr G.Robb had come in slightly and contributed to the breaking of Dollars Bromac.
--Mr.Hollis also believed that Mr.Smith and he had gone for the same gap, Mr.Hollis stated that the back on film showed this incident clearly.
--Both Mr.Taumanu and Mr.Hollis summed up.

Decision And Reasons.
--Having taken into consideration all of the evidence as presented from the video, Mr.Taumanu Mr.Hollis and Mr.Smith I find that Mr. Hollis did come out in a quick manner at or about the 120 meter mark and in doing so did strike the front legs of Dollars Bromac forcing this runner to break stride and lose its chance of finishing in a higher place. I find no evidence of Speedstar coming down and contributing to any degree in this incident as alleged by Mr. Hollis.
--It is my finding that Mach Express has gained an advantage by causing interference to Dollars Bromac at this crucial stage of the race and the protest is upheld.
--Mr Taumanu sought relegation of Mach Express behind Dollars Bromac to ninth place
--Under the provisions of Rule 1003, I order that Mach Express be relegated to ninth place .
--The amended placings shall now read 1st No 1, 2nd No5, 3rd No 11, 4th No 6, 5th No 7, 6th No 9.
