Evidence:

Following the running of Race 8 (AB Equipment/PTS Logistics 1600), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638 (1) (d) in that Z Moki allowed her mount to shift inwards shortly after the start checking CAPE DU JEU and PORTLAND JIMMY.

This charge was heard at Trentham on Saturday 25th May 2019. Ms Moki was not present due to injury. Her employer Mr Vile and Ms Moki admitted the breach and were comfortable for the hearing to proceed in their absence.

Mr Goodwin showed the video replays of the early part of the race and said that Ms Moki allowed her mount MYRTLE, to shift inwards when not sufficiently clear of CAPE DU JEU, who in turn was forced down onto PORTLAND JIMMY, who had to steady.

Decision:

As Ms Moki admitted the breach it was found proved by the Committee.

Submissions for Penalty:

For the Stewards Mr Goodwin said that Ms Moki had only one careless riding breach in the last 12 months, and he placed the carelessness on this occasion in the low range category.

Reasons for Penalty:

After viewing the films the Committee placed the carelessness exhibited by Ms Moki to be low-range. Taking into account Ms Moki’s record and the admittance of the breach the Committee determined that a 5-riding day suspension was a suitable penalty.

Penalty:

Accordingly, Ms Moki’s Apprentice Jockey’s License was suspended from the close of racing today, May 25th 2019 up to and including racing on Sunday, June 2nd 2019.
