Following Race 1, an Information was filed pursuant to Rule 638 (1) (D).  The Informant, Mr Oatham, alleged that Mr Razali allowed his mount MONARCH to shift inwards near the 900 metres.  He further alleged that Mr Razali was not sufficiently clear of ROI D’JEU (J Waddell) who was checked.

INFORMATION NUMBER 151

Following Race 1, an Information was filed pursuant to Rule 638 (1) (D).  The Informant, Mr Oatham, alleged that Mr Razali allowed his mount MONARCH to shift inwards near the 900 metres.  He further alleged that Mr Razali was not sufficiently clear of ROI D’JEU (J Waddell) who was checked.

Mr Razali pleaded guilty to the charge and was represented by Mr K Hughes, Licensed Trainer.

Mr Coles demonstrated the video films and showed to the Committee, at a point approaching the 900 metres, Mr Razali riding MONARCH racing in a position 2 ½ horse widths off the rail.  Mr Razali then moved in towards the rail taking the line of ROI D’JEU (J Waddell) when only ¾ to 1length clear.  This caused Mr Waddell to take a hold and check his mount.

Neither Mr Razali nor Mr Hughes had anything to say when asked.

PENALTY SUBMISSIONS

Mr Oatham said Mr Razali was still very inexperienced and in a short career had incurred one 4 day suspension.  He submitted this offence was at the low end of carelessness being an error of judgement.

Mr Razali said he had commitments until 3 January 2010.

PENALTY

--

The Committee carefully considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Mr Razali’s inexperience and his guilty plea.  However Mr Waddell did have to check his mount thus losing his rightful position in the running.  We agree Mr Razali’s carelessness was at the lower end and accordingly we impose a suspension to start after racing on 3 January 2010 and conclude after racing on 9 January 2010 (4 days)
