--The breach of the rule was admitted.
--Stipendiary steward Goodwin, using the available films, informed the committee that the films showed Dell’s mount in 5th place at the 50 metre mark and that through lack of vigor by the rider he was beaten into 6th place.
--The difference in prize money was $175.00
--Mr Dell told the committee he had been riding in amateur races for two years and this was his thirteenth ride. He said the horse was not offering much and gave up riding it out when it drifted. He was aware of his obligations. Mr Goodwin informed the committee that this was Mr Dell’s first offence. Stake money of $175.00 was lost to the connections of Mr Dell’s mount by his actions. It was certainly not at the top end of the scale and although he was aware Mr Dell did not receive a riding fee he asked for a fine of $100.00.

--In coming to its decision to impose a monetary penalty for the offence we have taken into account your admittance of the breach and your record under this rule.
--The committee fines you the sum of $150.00.
