At the conclusion of race 3, the Awards Committee 2YO Mobile Pace, a protest was lodged by Stipendiary Steward Mr C J Allison into the first placed horse COURAGE TELLS (A Beck) under Rule 869 (6) (b) (c). The Rule reads … (b) A horse making a forward movement during any race shall not be forced to race wider on the track; (c) A horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner, going forward, is fully past.
--Stipendiary Steward Mr Allison requested his colleague Mr P Knowles show the video films of the alleged incident.
--Mr Knowles stated there were two separate incidents the Committee had to consider. After the mobile arm had been dispatched, Mr Knowles highlighted CHRISTIAN RULER (B Barclay) went to the front and was trailed by SEEL N PRINT (P Court) who in turn was followed by COURAGE TELLS (A Beck) effectively settling three back on the pole line. LE SOL (T Stratford) was racing two back and one off the pole line. As the race progressed, SEEL N PRINT moved out of the trailing position, initially following that line, but then reverting back to the trailing position. It was from this position COURAGE TELLS moved forward and outwards following SEEL N PRINT and it was at this point the stipendiary stewards focused on an alleged breach of the Rule.
--Mr Stratford stated and agreed with the observations of Mr Knowles and Mr Allison, highlighting that, in his opinion, his horse was moving forward and entitled to. Mr Stratford maintained that his horse LE SOL was forced three wide by COURAGE TELLS, where he remained for 300 metres, stating that his horse should have been in the one one position, and as he was only beaten by half a length he could have won the race.
--Mr Beck (COURAGE TELLS) did not dispute the comments made regarding the racing order and positions. However Mr Beck explained that when his horse was in the trailing position he was over-racing and as a result he moved outwards. Mr Beck also stated that in his opinion he was legally entitled to move outwards, because Mr Stratford’s horse was not moving forwards, in fact LE SOL had lost some ground on his horse COURAGE TELLS.
--DECISION / REASON
--The Committee was satisfied that the visual and verbal evidence was inconclusive and created sufficient doubt for the protest to be dismissed.
--In the Committee’s opinion LE SOL (T Stratford) was not moving forward at the time of the alleged incident. The Committee felt in this case the interpretation of this particular Rule relies heavily on the terminology of “forward movement”.
