Jarrod Todd, near the 250 metre mark angled his mount MONET SPINNA out and into the line of LEAVEITOME (K Collins) when not clear, causing LEAVEITOME to be checked. Rule 871 (1) (D).

--The breach of the rule was admitted.
--As the charge was admitted Stipendiary steward N Goodwin, using the available films (head, side and back) pointed out to the committee the incident which clearly showed the line being taken of LEAVEITOME by the actions of Jockey Todd, riding MONET SPINNA. He believed that Jockey Todd shifted ground before he looked.
--This was confirmed by Jockey Todd who readily admitted it was an error of judgement.
Stipendiary steward Goodwin informed the committee that J Todd was last charged under this rule 7 March 2009 when he was suspended for four days. He believed the incident was in the lower to middle bracket and that he felt it could be reflected with a period of suspension and suggested four days. He told the committee that Jarrod Todd rode throughout New Zealand and was a busy jockey.
Jockey Todd confirmed that he did ride throughout New Zealand and had built a good relationship with a number of North Island trainers.
--DECISION AND REASON
In coming to our decision to impose a period of suspension for this offence we have taken into account your guilty plea, your comment that it was an error of judgement and the fact that you ride throughout the country.
We have also taken into account your preference for any period of suspension to begin after the completion of racing at Oamaru, Sunday 7 June 2009.
You are suspended from race riding at the completion of racing on Sunday 7 June until the completion of racing on Saturday 13 June (four days).
