Following the running of race No 4 an information was filed alleging a breach of rule 870 and the breaking Horse regulations
| -- Following the running of Race 4 an information was filed alleging a breach of rule 870 and the breaking horse regulations. The informant was Mr J M Muirhead and this was a protest against horse No.7 ROSCOE on the grounds that ROSCOE had broken from it's gait and failed to promptly regain it's gait.. The judges placings for this race were 1st - No.9, 2nd - No 8, 3rd - No.7, 4th -No.1, 5th -No 11, 6th -No 3. --The trainer of ROSCOE did not wish to contest this protest and acknowledged that ROSCOE had been in breach of rule 870 and the breaking horse regulations. --Mr Milina was not present at the hearing --Mr Muirhead showed the video of the concluding stages of this race and it was clear the Roscoe had indeed been in a gallop for the final 80 meters of this race and had failed to promptly regain his trotting gait. --Mr Muirhead sought disqualification of ROSCOE from it's third placing. --Decision And Reasons. --Having viewed the video of this incident and taking into consideration that the connections did not contest this protest. This Judicial committee orders the disqualification of ROSCOE from third place in Race 4 given our discretion under rule 1003. --The amended placings shall now read 1st No 9, 2nd No 8, 3rd No 1, 4th No 11, 5th No 3, 6th No 6. --
