Following the running of Race 4, The Gibson Sheat Lawyers 1600, Mr. B. Lammas  was charged with careless riding under rule 638 (1) (d). The information alleged that he permitted his mount CHARLIE McBRIDE to shift outwards passing the 200m when not sufficiently clear of VOLGUS (L. --

Mr. Lammas admitted the breach.

--

Mr. Goodwin showed head-on films of the final stages of the race where Mr. Lammas allowed his mount to shift outwards into the line of Mr. Innes who then made contact with Mr. Walker further out. Mr. Goodwin said there may have been some slight movement inwards from ZAGAZIG but if there was it was minimal.

--

Mr. Lammas said that VOLGUS had been racing greenly and his own mount, CHARLIE McBRIDE started to drift when it reached the front. He was trying to hold it straight and once he heard Mr. Innes call to him he did take corrective action. He said that Mr. Innes should have called out to him earlier.

--

Mr. Oatham said Mr. Lammas has had two careless riding charges in the last 12 months:

--

10/10/09     Hawera         6 days
12/3/09       Wanganui     3 days

--

In his opinion the interference could be classed as mid-range.

--

Mr. Lammas asked the committee to consider how greenly Mr. Innes’s horse was racing.

--

PENALTY

--

In coming to a decision on penalty the committee considered all of the submissions. We have given credit for Mr. Lammas’s admission of the breach and his good riding record.  The degree of interference suffered by Mr. Innes may have been in the mid-range however we accept that VOLGUS was racing greenly and in our opinion the level of carelessness displayed by Mr. Lammas was in the lower range. He did try to correct his outward movement once he was aware of Mr. Innes but he probably should have stopped using the whip two strides earlier than he in fact did.

--

Mr. Lammas is suspended from the conclusion of racing on Monday February 1st until the conclusion of racing on Saturday February 6th – in effect 4 days.
