He believed he was engaged to ride the horse Mandela in Race 9, the Stella Artois Auckland Cup. He said in his opinion he had a firm engagement after Mr R Yuill, trainer of Mandela, told him he would trial the horse at Breakfast with the Stars prior to Cup Week. However Mr Ormsby was unable to attend this session and did ring to tell Mr Yuill this the day before. However he still believed he had a firm engagement and only found out he wasn’t engaged on Derby day.

Mr Yuill said as far as he was concerned it was never a firm engagement and was to be confirmed after Breakfast with the Stars. As Mr Ormsby was unable to attend that was the end of any engagement Mr Ormsby thought he had.

DECISION
----
The Committee considered all evidence and told Mr Ormsby this was a case of Mr Ormsby assuming he had a firm engagement. The Committee believes an integral part of the engagement was how the horse performed at the Breakfast with the Stars session. Mr Ormsby failed to honour this part of the engagement he may have had and failed to confirm with Mr Yuill whether he was still on the horse or not.

Accordingly Mr Ormsby’s request is declined.
