Mr Knowles, stipendiary steward, alleged that Mr A Beck, licensed horseman, with approximately 300 metres to run, drove carelessly, causing interference to SEA KING and LITTLE RUSKY.

--Mr Beck admitted the charge which we thus find proved.
--We have viewed the incident from a number of video angles. Mr Beck’s drive, TROJAN, was clearly hanging for some distance prior to its coming into contact with SEA KING. Mr Beck demonstrated on the videos that he had refrained earlier from progressing past Mr Barclay who was racing 2 out because of the fact that TROJAN was hanging. He said he was using Mr Barclay’s horse, HEMISPHERE, for protection and was trying to keep TROJAN off that horse. He said he was not using the whip and did not believe he could have done much more to keep TROJAN out. Unfortunately for Mr Beck, Mr Barclay moved in when a gap presented itself and TROJAN, in following HEMISPHERE down, came into contact with SEA KING. Mr Knowles has said that Mr Beck continued to drive his horse out rather than keep it off SEA KING. Mr Beck, by his plea, has accepted that he was careless, in so doing. And we agree. The incident has cost 2 horses, at least, (further horses were less severely interfered with) any chance of finishing in a dividend bearing position.
--Mr Knowles has asked for a penalty in the range of $300 to $400. Mr Beck has an excellent record with no breach of this rule for at least 2 seasons. We give weight to this fact, the admission of the breach, and that Mr Beck was experiencing a difficult drive, and impose a fine at the bottom of the range suggested by Mr Knowles. Mr Beck is fined the sum of $300 and reminded of his obligations under the Rules of Harness Racing.
