Following the hearing of the inquiry into Race 3, Mr Ching preferred a charge pursuant to Rule 871(1)(d) of the Rules of Racing in which he alleged that Mr LM Robinson, the rider of "BlueonIce" allowed his mount with approximately 100 metres to run to move outwards causing interference

DECISION AND REASON
--Following the hearing of the inquiry into Race 3, Mr Ching preferred a charge pursuant to Rule 871(1)(d) of the Rules of Racing in which he alleged that Mr LM Robinson, the rider of "BlueonIce" allowed his mount with approximately 100 metres to run to move outwards causing interference to "Southern Thunder" (LK Crop) and "Kerry Lord" (K Myers) when not sufficiently clear.
--Mr Robinson did not admit the breach of the Rule.
--As a result of the inquiry into the incident alleged, "BlueonIce" was relegated to fourth position.
--"BlueonIce" was racing on the rail with approximately 200 metres to run. In Mr Robinson's words his horse was "racing greenly". Mr Robinson showed us on the video film how at one point, "BlueonIce" came into contact with the running rail. As a consequence, Mr Robinson struck his horse on the shoulder to bring him off the rail. (It should be noted that Mr Robinson is left handed.) In the last 50 to 100 metres, "BlueonIce" moved outwards coming into contact with "Southern Thunder" (LK Crop) which in turn took the line of "Kerry Lord" (K Myers).
--At the time that "BlueonIce" came into contact with "Southern Thunder", both horses appeared to be racing on even terms. Mr Robinson, riding with some vigour using the whip, allowed his mount to move outwards causing the interference to "Southern Thunder" and with consequential interference to "Kerry Lord" as referred to above and in the evidence that we heard in the inquiry.
--Mr Robinson maintained that "Southern Thunder" rolled in on him. We conclude from a careful study of the video film that any inward movement from "Southern Thunder" had finished by the time Mr Robinson took the gap behind the second placed horse, "Bubbles of Kash", which at all material times was in front of him. "Southern Thunder" at the moment of contact was, in fact, on a line that it was entitled to hold.
--Having considered all of the above including the submissions of Mr Robinson, we find that the conclusion is inescapable and that is that Mr Robinson rode carelessly. Mr Robinson caused the interference alleged by effectively "barging" his way out.
--The Information is proved accordingly.
--PENALTY DECISION
--Having heard from Mr Ching and Mr Robinson with regard to the question of penalty, we do not agree, as Mr Robinson said, that the carelessness can be considered minor, particularly having regard to the consequences which followed from the result of the inquiry.
--We therefore are bound to impose a suspension. We acknowledge that Mr Robinson did have a difficult mount and that to a limited extent, the horse was responsible for the interference. However, Mr Robinson is an experienced jockey. He continued with the use of the whip and did not take any recognisable measures to control the actions of his horse.
--Mr Robinson is accordingly suspended from the conclusion of racing on Saturday 12th November until the close of racing on Saturday 3rd December 2005.
--In setting the penalty, it should be noted that the starting point for carelessness of this degree is at least four days, but after giving careful consideration to Mr Robinson's otherwise good riding record and the limited contribution of the horse to the interference, we have set the suspension at three days.
