DECISION & REASONS:
--An Information was lodged by Stipendiary Steward Mr T Taumanu against Mr W Thomas, driver of THE MAJORCAN, alleging a breach of Rules 869(4), 869(6)(b) and (c) ? push out ? in that he moved his horse from the two wide line to three wide with about 1200 metres to run, forcing CITRA JATI, driven by Mrs L Neal, to race wider on the track.
--Mr Thomas admitted the breach and did not wish to be present at the hearing.
--Mr Taumanu demonstrated the incident by use of the video. Clearly Mr Thomas moved his horse outwards when not entitled to do so and forced CITRA JATI wider on the track. However, CITRA JATI was able to move past THE MAJORCAN immediately and return to the three wide line.
--Penalty:
--Mr Taumanu said Mr Thomas had no breaches of the rules recorded against him. He suggested a fine of $200. In fixing penalty the Chairman took into account the following matters ?
--1. The guilty plea
--2. The clear driving record of Mr Thomas
