Mr Bishop stated that his boss, Mr R Donnelly, had accepted the ride and that he (Mr Bishop) believed that he could make the weight. Mr Bishop was replaced by jockey A Munday.

Mr Ching stated that whilst Mr Bishop was a genuine and honest person who was doing his best to conform to the rules, he should not have accepted the ride. Mr Ching also stated that he would hope that the Committee would consider a 'deterrent' monetary penalty - taking into account that Mr Bishop had previously been fined $100 for the same offence. Mr Smellie (for Mr Bishop) commented that perhaps the ride had been accepted prior to the weight being listed.
