Following the running of Race 3, the NRM NZ Sires' Stakes Series (Heat 2), an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr G. D. O?Reilly, driver of "Rocket Reign" (2), alleging a breach of Rule 869(3)(b).

DECISION AND REASONS:

Following the running of Race 3, the NRM NZ Sires' Stakes Series (Heat 2), an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr G. D. O?Reilly, driver of "Rocket Reign" (2), alleging a breach of Rule 869(3)(b). The charge was that Mr O?Reilly drove carelessly with about 700m to run when shifting outwards with resultant interference to "Niraadi" (5) driven by Mr J. Dunn.

Mr O?Reilly indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. Video coverage of the incident was shown to illustrate that Mr O?Reilly had attempted to move outwards when there was insufficient room with resultant interference to "Day Of Our Lives", "Bourne Supremacy" and "Niraadi".

Mr O?Reilly did not seek to excuse his driving.

Penalty: Mrs Williams advised that Mr O?Reilly had no relevant previous convictions, and that he had been "open and up front" in his admission of this breach. As to penalty Mrs Williams made submissions that this was a breach that was at the higher end of the scale, and that the race was a $17,000 heat of a Sires' Stakes series where the chances of other horses had been affected. Mrs Williams recommended a 2 day suspension.

Mr O?Reilly said that he would prefer a fine to a suspension. Mrs Williams responded that if a fine were to be considered it should be in the region of $300-00 to $350-00. This was on the basis that a typical fine for careless driving is $200-00 to $250-00.

We retired to consider our decision, and on our return to the Enquiry Room we advised that Mr O?Reilly would be fined rather than suspended on this occasion. Our reasons for this decision were that Mr O?Reilly had not tried to minimise his carelessness, and had been frank in his admission of guilt. Although a fine of $350-00 would have been appropriate in this case we decided to impose a fine of $300-00 to take into account his guilty plea and clear driving record. Mr O?Reilly was fined the sum of $300-00.
