Following Race 10 an information was filed pursuant to Rule 871 (1) (d) by the informant, Stipendiary Steward Mr J Oatham. He alleged that Ms N Collett, rider of PINSTAR, angled out when not clear, dictating GREY SWALLOW,

Following Race 10 an information was filed pursuant to Rule 871 (1) (d) by the informant, Stipendiary Steward Mr J Oatham. He alleged that Ms N Collett, rider of PINSTAR, angled out when not clear, dictating GREY SWALLOW, ridden by M Hills, out into the line of ZABAAT, ridden by J Waddell, who was forced to check off the heels of GREY SWALLOW.

Ms Collett pleaded guilty and was represented by her employer, Mr R Collett.

Stipendiary Steward Mr A Coles demonstrated the video films and showed where at the 200 metre mark Ms Collett angled her mount outwards and took the line of GREY SWALLOW, ridden by M Hills when not the required distance clear. Mr Coles showed where GREY SWALLOW was forced into the line of ZABAAT, ridden by J Waddell, who had to be checked sharply off the heels of that runner.

Mr R Collett said, in Ms Collett's defence, that PINSTAR was difficult and erratic and over reacted when being angled out. Ms Collett concurred with Mr Collett's submissions.

PENALTY

--

Mr Oatham produced Ms Collett's record, which showed only 1 previous charge and submitted a suspension of 4 - 5 days would be appropriate. Mr Collett said Ms Collett had no commitments after Counties on the 21st May 2008.

DECISION

--

The Committee considered all submissions and before imposing a penalty took into account the following :

  2. Her guilty plea.
    3. --
  3. This was a premier day.
    4. --
  4. The severity of the interference received by Mr Hills and Mr Waddell.

Accordingly, we impose a suspension to start after racing on the 21st May 2008 and conclude after racing on the 29th May 2008 - 5 days.
