The protest lodged by the Stipendiary Stewards alleged interference near the 400 metre mark, by LORD TIOGA, placed first by the judge, to SURUMAN placed 3rd by the judge.

The Chairman was satisfied both parties were represented and asked Mr McCutcheon to read the rule. The rule was read and those present acknowledged they understood it. Mr McCutcheon also reserved the right to charge any rider involved in the alleged incident.

The protest lodged by the Stipendiary Stewards alleged interference near the 400 metre mark, by LORD TIOGA, placed first by the judge, to SURUMAN placed 3rd by the judge.

Mr McCutcheon demonstrated head-on and side-on films of the alleged incident. The films showed P Taylor, the rider of LORD TIOGA, move outwards prior to the home turn, pushing D Bradley's mount wider.

Mr Gray pointed out on the film that other horses, namely KEISANO (M Cameron) and STEEL A FORTUNE (K Smith) had also contributed to the alleged incident.

Mr Bradley, for his part when asked, said that he believed Mr Taylor's pushing out cost him 1-1/2 lengths and he was only beaten half a length for second.

Mr Wallace entered the room about halfway through the inquiry and was happy with proceedings and confirmed that he was happy with Mr Gray representing him.

In summing up, Mr McCutcheon said there was some doubt as to whether LORD TIOGA was the sole contributor of the interference to SARUMAN.

All those present acknowledged they had nothing further to add and left the committee to arrive at a decision.

The committee were of the view, whilst there had been some inconvenience caused to SARUMAN by LORD TIOGA?S outward movement, that horse was not the sole contributor.

The committee used their discretionary power and dismissed the protest, they did not however, consider the protest to be of a frivolous nature.
