Following the running of Race 5, Guy Dampier-Crossley Maiden, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr P T Holmes, alleging a breach of Rule 871 (3) in that Mr Holmes “made a celebratory gesture prior to the finish line on his mount MISSDAFLIGHT”.



DECISION AND REASONS:

Following the running of Race 5, Guy Dampier-Crossley Maiden, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr P T Holmes, alleging a breach of Rule 871 (3) in that Mr Holmes “made a celebratory gesture prior to the finish line on his mount MISSDAFLIGHT”.

Mr Holmes was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.

Rule 871 provides as follows:

--

(3)     Every rider commits a breach of these Rules who in the opinion of the Judicial Committee makes   any celebratory gesture prior to his horse passing the winning post.

Mr M R Davidson, Stipendiary Steward, showed head-on and side-on video replays of the final stages of the Race. He pointed out, just prior to the finishing line, Mr Holmes raise his left hand, in which he held his whip, in a celebratory gesture. It was just 1-2 strides prior to the finishing line.

Mr Ching informed the Committee that Mr Holmes had won a race at Wellington on 28 February, the Group 3 Lowland Stakes, and was fined $300 for a breach of the Rule. Today’s race was a maiden event (winning stake $4,400). Mr Holmes part-owns MISSDAFLIGHT and the excitement got to him prior to the post, Mr Ching said.

Mr Ching sought a fine of between $100 and $200.

Mr Holmes explained that the horse, which was having its first start, is part-owned by him and the excitement got to him. Mr Holmes agreed that the gesture was made in the last stride or two and, he submitted, was done with safety.

Taking all of the above matters into account, in particular Mr Holmes’ admission of the breach and the proximity to the winning post, and notwithstanding the Committee’s concern over the very recent breach of the same Rule, Mr Holmes was fined the sum of $150.

--

Mr Holmes is urged to take more care in the future.
