PENALTY
--Mr Goodwin, when addressing the committee, submitted that a modest fine was the appropriate penalty to be imposed, while Mr Laursen, in his submissions, stated that he believed the matter only warranted the committee issuing a warning.
--When considering the question of penalty the committee are mindful that a clear obligation rested with Mr Laursen to ensure that Miss Satherley was licensed, or at least had applied to be licensed, when she commenced her employment with him. Although this requirement is relatively new it nevertheless has been well publicised of late and on this occasion Mr Laursen has not discharged his obligations as required.
--Mr Laursen was aware of his duty and as such a warning is not appropriate, but rather a fine is the penalty that should be imposed.
--A factor in mitigation is that Mr Laursen has readily admitted the breach. The committee also recognises that this rule has only recently been adopted and as such some latitude should be accorded.
--After taking all matters into account it is this committees finding that Mr Laursen be fined the sum of $50.00
