DECISION OF JUDICIAL COMMITTEE

Information No. 0814 alleges a breach of Rule 528(1) by Halie Jospehs and the breach has been admitted.

--

Racecourse Inspector Mr BF McKenzie confirmed the defendant had been drug tested at the Matamata Racecourse, during track-work, on Thursday the 8 June 2006.

--

A sample of urine supplied by the defendant was sent to the ESR for testing. Upon analysis it was found that sample ID No.346307 for Halie Josephs had tested positive to cannabis.

--

Miss Jospehs is a regular track rider. She has an unblemished previous record.

--

Mr McKenzie recommended a penalty of $400, and $200 towards NZTR costs was sought.

--

The defendant confirmed that she was not a regular user of cannabis.

--

Taking this into account and her good record, the Committee imposed a fine of $400, plus costs of $200 for NZTR, and ordered a further $100 contribution to the JCA.
