DECISION AND REASONS:
--Following the running of Race 1, The Met Welcomes HRNZ Conference Delegates Trot, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against ZANDARA (M P Jones), placed 4th by the judge, on the grounds of breaking from its gait over the concluding stages of the race.
----Mr M P Jones, driver of ZANDARA, had signed the following statement which had been endorsed on the information form: "We do not contest the protest and accept the horse should be disqualified". Mr Jones was not present at the hearing of the information.
----Mr N R Escott, Chief Stipendiary Steward, showed a video replay of the final stages of the race. He pointed out ZANDARA, which had trailed the leader to the home turn, take the passing lane. When challenging for the lead, ZANDARA broke from its gait and continued in a gallop to the finishing line. Mr Escott alleged that ZANDARA had galloped for a distance well in excess of 50 metres, in breach of the Breaking Horses Regulation, and this was clearly borne out by the video replay.
----The Committee was satisfied based on Mr Jones' admission, Mr Escott's evidence and the video evidence that ZANDARA had broken from its gait inside the final 200 metres of the race and had continued on in the break for a distance of 50 metres or greater in breach of the Breaking Horses Regulation and, accordingly, in terms of that Regulation, the Committee was required to disqualify ZANDARA from the race.
----ZANDARA was disqualified accordingly and, consequent upon the disqualification, the amended placings for the race are as follows:
--1st 9 Dalriada Abbe
--2nd 4 Just Begun
--3rd 2 Corporal
--4th 8 Stringy Bark
--5th 5 Love Hate Revenge
--6th 12 Azulike
