Decision: Following the running of Race 8, the Lone Star Riccarton Handicap Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of the “lapped on” rule, Rule 870(5), by “Miss Warbucks” (5).

Following the running of Race 8, the Lone Star Riccarton Handicap Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of the “lapped on” rule, Rule 870(5), by “Miss Warbucks” (5).  Mr R. H. Jenkins, the trainer and driver of “Miss Warbucks”, attended the hearing and he advised that he represented the interests of the owners of the horse.

Mr Jenkins made it clear from the outset that he did not contest that “Miss Warbucks” had broken from its correct gait a short distance before the finishing line, and that it was still in a break when it reached the finishing line. Mr Jenkins said that his concern was that the margin between 4th and 5th had been given as one length, and that this indicated that his horse had not been lapped on to the 5th horse.

The photo finish of the race was shown and it could be seen that “Miss Warbucks” was in fact lapped on to “Delcola”.  Mrs Williams explained that when a margin was more than ¾ of a length it was given as being a full length.  The Judge, when giving margins between placed horses, has no official margin available to him between ¾ of a length and one length.

The print-out of the official places as the field crossed the finishing line showed that the 4th horse finished 1.9 lengths behind the winner, and that the 5th horse finished 2.8 lengths behind the winner.  The margin between 4th and 5th was therefore .9 of a length, and this is what was shown on the photo finish.

After hearing the evidence I was satisfied that “Miss Warbucks” was lapped on to “Delcola” as alleged and I advised the parties that “Miss Warbucks” would be relegated to 5th place.  The amended places are as follows.

Decision:
