DECISION AND REASONS:
Following the running of Race 3, Adam White Farrier & Forge Horseshoes Mobile Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Miss A J Laing, alleging a breach of Rule 869 (3) (b) in that Miss Laing, as the driver of SURE SWIFT in the Race, “drove carelessly allowing her horse to strike the sulky wheel of BORN LUCKY (G C Telfer) which resulted in a number of horses being interfered with”.

Following the running of Race 3, Adam White Farrier & Forge Horseshoes Mobile Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Miss A J Laing, alleging a breach of Rule 869 (3) (b) in that Miss Laing, as the driver of SURE SWIFT in the Race, “drove carelessly allowing her horse to strike the sulky wheel of BORN LUCKY (G C Telfer) which resulted in a number of horses being interfered with”.
Miss Laing was present at the hearing of the information and admitted the breach.
--Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
(b) carelessly
Mrs Williams submitted that this breach was at the high end of careless driving because of the interference to the other runners in the Race. She said that the Stewards were seeking a suspension of 4-6 weeks or a fine of $350.
--Mr N G McIntyre, Stipendiary Steward, showed video replays of the incident with approximately 600 metres to run. He pointed out Miss Laing in the two-out line and on the back of BORN LUCKY. Miss Laing then shifted out and Mr Telfer shifted out in front of her as he was entitled to do. Miss Laing then attempted to get back onto Mr Telfer’s back and, in doing so, contacted the outside sulky wheel of BORN LUCKY and dislodged Mr Telfer. As a result, Mr McIntyre said, HIGHLY SPECIFIC (A E Veint), ABSOLVED (D J Butt) and SIR RON (M P Jones) were all “hampered”, with ABSOLVED being brought down.
--Miss Laing had no comment to make regarding the incident. She said that she would prefer a fine to a term of suspension. Mrs Williams informed the Committee that Miss Laing had 78 drives in the 2007/2008 season and, in the current season to date, had had 146 drives. Miss Laing had a clear record, Mrs Williams said.
--In determining penalty, the Committee took into account Miss Laing’s admission of the breach and her previous good record. However, the Committee agreed with Mrs Williams that the degree of carelessness was at the higher end of the scale. Any penalty needs to reflect that.
--The Committee was satisfied that the matter could be dealt with by way of a fine rather than a suspension and the Committee was of the view that the fine recommended by Mrs Williams was appropriate in all of the circumstances.
--Miss Laing was fined the sum of $350.
