Following Race 6 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr A Coles alleged that passing the 750 metres Mr V Ho riding SOLOSINGA allowed his mount to shift in when not sufficiently clear causing tightening to ORIENT EXPRESS (S Collett). She in turn shifted in and tightened THREE FOR BUSTER (J Collett) who was quite severely checked.

Following Race 6 an Information was filed pursuant to Rule 871 (1) (D). She in turn shifted in and tightened THREE FOR BUSTER (J Collett) who was quite severely checked.
--Mr Ho pleaded guilty to the charge and was represented by Trainer Mr R Manning.
--Mr M Williamson demonstrated the video films which showed SOLOSINGA moving in when not the required distance clear. This occurred at the 750 metre mark and the resultant checks to two horses were quite pronounced with THREE FOR BUSTER losing considerable ground.
--PENALTY SUBMISSIONS
--Mr Coles produced Mr Ho’s record which showed that Mr Ho had incurred one 7 day suspension on 2nd May. Mr Coles said the state of the ground today may have contributed to the interference but it was still Mr Ho’s obligation to keep his mount straight. He submitted a 4 day suspension was appropriate.
--Mr Ho told the Committee he had commitments up to and including 1 August 09.
--PENALTY
--The Committee considered all the presented evidence and submissions and before imposing an appropriate penalty explained to Mr Hothat although the ground was bad it is still the obligation to keep his mount straight and make sure he was the required distance clear when moving in.
--However in fixing a penalty the Committee did take the state of the ground into account as well as Mr Ho’s guilty plea and riding record.
--Accordingly we impose a suspension on Mr Ho from riding in races to start after the conclusion of racing on 1 August and conclude after racing on 8 August 09 (4 days).
