Decision: Following race 4 an information was filed by the informant, Mr J Oatham, pursuant to Rule 871(1)(d).  He alleges that Mr N Harris, rider of PREEMO, permitted his mount to shift out when not clear of APATCHEE TUTE

DECISION & REASON:

Following race 4 an information was filed by the informant, Mr J Oatham, pursuant to Rule 871(1)(d).  He alleges that Mr N Harris, rider of PREEMO, permitted his mount to shift out when not clear of APATCHEE TUTE resulting in that runner being checked.

Mr Harris pleaded guilty to the charge.

Mr A Coles, Stipendiary Steward, demonstrated the video films and showed where at the 300 metre mark Mr Harris permitted his mount PREEMO to shift out when not clear of APATCHEE TUTE, resulting in that runner being checked.

Mr Harris in his submissions said he thought he was clear and did not hear calling from Mr Parish.  He then asked for a 7 day deferral as he was engaged for the Rotorua Cup on 3 May.

Mr Oatham produced Mr Harris’ record which is an outstanding one.  He believed the degree of carelessness was at the lower end and asked for a 4 to 5 day suspension.

The Committee considered all submissions and before imposing any penalty considered the following:

--

1.            Mr Harris’ riding record which is an outstanding one.

--

2.            His early guilty plea.

--

3.            The interference itself which the Committee considers to be at the low end of carelessness.

--

4.            Mr Harris’ request for a 7 day deferral.

--

PENALTY:

--

Accordingly we agree to Mr Harris’ request and impose a suspension to start after racing on 3 May and conclude after racing on 10 May (4 days).
