Decision:
Following the running of race 10, the Otaki Printers 1400, K Collins the rider of ANNHEE DANCED, the winner of the race, was charged with a breach of Rule 871 (3).
Following the running of race 10, the Otaki Printers 1400, K Collins the rider of ANNHEE DANCED, the winner of the race, was charged with a breach of Rule 871 (3).
--It was alleged that Mr Collins breached the provisions of the rule when he made a celebratory gesture prior to the finish of the race.
--Mr Collins admitted the breach of the Rule.
--PENALTY.
--Prior to receiving submissions on penalty the committee were shown the films of the finish of the race, these clearly demonstrating Mr Collins flourishing his whip some 2- 3 strides short of the winning post.
--Mr Goodwin then presented Mr Collins's record which showed no previous breaches of this Rule.
--It was Mr Goodwin's submission that the matter should be dealt with by way of a modest fine.
--Mr Collins, although admitting the breach, did nevertheless state that he did not believe that the charge should have been bought in the first place. He contended that it was just a very minor flourish and of very little significance.
--He had nothing to say regarding penalty.
--The committee, having had an opportunity to view the films of the finish of the race, are of the view that the incident complained of falls at the lower end of the scale and as such the penalty imposed should reflect this.
--Mr Collins has clearly raised his whip upon approaching the finish however his actions could not be categorised as being extravagant, but rather they were somewhat subdued.
--Nevertheless the rule has been transgressed and it is the duty of this committee to determine an appropriate penalty. In assessing penalty we have had regard to recent decisions concerning breaches of this rule, and in particular we have carefully considered where we see this breach resting against these decisions.
--Therefore after considering all factors it is the finding of this committee that Mr Collin be fined the sum of $200.00
