Following race one an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr A Scott, trainer of ZERGAR, that KAAPTIME placed second by the Judge interfered with his horses chance in the home straight.

DECISION & REASON:
--Following race one an information was filed pursuant to Rule 876(1) when it was alleged by the informant, Mr A Scott, trainer of ZERGAR, that KAAPTIME placed second by the Judge interfered with his horses chance in the home straight. The margin between third and fourth was a long neck.
----Mr Scott demonstrated both video films and showed KAAPTIME rolling out into the line of ZERGAR. He believed ZERGAR as a result of having to cover extra ground lost approximately one length.
----Mr J Collett, rider of ZERGAR, said that he opted for a run outside KAAPTIME but when KAAPTIME rolled out he was forced onto IN POWER (M Innes). He said his line was then dictated to the line which he believed cost him a length.
----Mrs T Thornton in her statement said her mount did roll out but there was no contact between her and Mr Collett. She said in her opinion it did not cause Mr Collett to lose a length.
----Mr C Finn confirmed his jockey's comments.
----Mr Oatham when asked for his interpretation of the incident said that there was no contact between KAAPTIME and ZERGAR and that there was also inward movement from BEERSHEBA KNIGHT (C Lammas) onto IN POWER ridden by M Innes. He also said he had doubt that the incident cost ZERGAR a length as stated by Mr Scott and Mr J Collett.
----The first question the Committee must address is whether there was any interference. While we agree there was outward movement from KAAPTIME towards ZERGAR we are of the opinion that this movement did not affect the chances of ZERGAR finishing in a better place. Accordingly the protest is dismissed and the Judge's placings shall stand.
