Decision: Following race 9 an information was filed pursuant to Rule 871(!)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr D Walsh, rider of D?ARTAGNAN committed a breach of that rule
Following race 9 an information was filed pursuant to Rule 871(!)(d) when it was alleged by the informant, Stipendary Steward Mr J Oatham, that Mr D Walsh, rider of D?ARTAGNAN committed a breach of that rule when he shifted inwards near the winning post when not sufficiently clear of THE ICEMAN (S Fieldes) who clipped a heel and stumbled badly. Mr Walsh did not admit the charge.

Mr Robinson demonstrated the film with particular emphasis on an incident as the field passed the post on the 1st occasion. He showed where Mr Walsh, on his mount D?ARTAGNAN, moved in to be closer to the rail. In doing so THE ICEMAN ridden by S Fieldes, was seen to clip the heels of D?ARTAGNAN and stumble badly. Mr Robinson said that, in his view, although tending to over race a little THE ICEMAN was entitled to be where he was.

Mr S Fieldes, who was represented by Mr A Fieldes, said that although his mount was over racing a little he had room in front of him until Mr Walsh came across and took his line.

Mr Wash did admit that he did come across in front of THE ICEMAN as shown on the film. He said that he was not aware of THE ICEMAN's position and when he heard a call he thought it had come from his inside. He was not aware that there had been an incident until spoken to by the Stipendary Steward. After reviewing all evidence including Mr Wash's admission ?that he may have cut him a little short? the committee prefer the evidence of Mr Oatham and find the charge proven.

PENALTY: Mr Oatham gave Mr Wash's record and asked for a suspension.

Mr Walsh said that Mr Fields inexperienced mount could have contributed to the offence.

The committee, after taking all matters in to account do not believe that there are any mitigating circumstances that can reduce the penalty to less than 4 days suspension.
--Consequently we suspend Mr D M Wash from riding from the conclusion of racing on 1 January till the conclusion of racing on 10 January 2007.
