An information was lodged by Stipendary Steward Mr T Taumanu, pursuant to Rule 858 (a) & (b), against Trainer Mr G Small, on the grounds that in Race 9, HIGH FLYIN was presented late into the birdcage and onto the track
An information was lodged by Stipendary Steward Mr T Taumanu, pursuant to Rule 858 (a) & (b), against Trainer Mr G Small, on the grounds that in Race 9, HIGH FLYIN was presented late into the birdcage and onto the track (7 minutes) prior to race start time.
----Mr G Small did not admit the breach of this rule.
--Mr G Small was present at the hearing.
----Mr T Taumanu advised he was in the parade ring prior to Race 9 and noted that High Flyin was not only late into parade ring, but did not go onto the track until 7 minutes prior to race start time.
----Mr G Small in his defence, stated that he was waiting for the Cup speeches to finish, as he could hear them over the oncourse sound system, and although the horse was geared up, he felt it unsafe to proceed to birdcage area until proceedings were completed.
----Mr G Small also stated that Kids Cart had a presentation after the Cup as well.
----In respect of penalty Mr T Taumanu recommended a $100 fine.
----The Judicial Committee considered all of the evidence given and found the charge had been proven and accordingly imposed a fine of $100 on Mr G Small.
