This was an information laid by Mr McIntyre, stipendiary steward, alleging that with approximately 250 metres to run HEATHER CASTLETON broke checking GOLD REPLY. He sought the relegation of HEATHER CASTLETON to behind GOLD REPLY.

Informant:      Mr N McIntyre, stipendiary steward

This was an information laid by Mr McIntyre, stipendiary steward, alleging that with approximately 250 metres to run HEATHER CASTLETON broke checking GOLD REPLY. He sought the relegation of HEATHER CASTLETON to behind GOLD REPLY.

Judges placings were 7, 6, 4, 9, 13, 5/14. The margins between 4th and 6th were ¾ L and a nose.

Mr McIntyre demonstrated on 3 video angles that HEATHER CASTLETON had broken at the point of the home turn and come back on to GOLD REPLY. The driver of GOLD REPLY, Mr Matthew Williamson, a junior driver, indicated he would represent the connections and that he did not need the assistance of a senior driver. He stated that he was trailing HEATHER CASTLETON when it broke and had suffered interference as that horse came back on to him. He said he believed he had lost at least 2 lengths as a result of the incident.

We found we obtained the most assistance from the back straight video. This demonstrated that HEATHER CASTLETON broke when free of interference and came back on to GOLD REPLY. We note that GOLD REPLY almost climbed into the cart of HEATHER CASTLETON, paced roughly and was slowed nearly to a stop. We are satisfied GOLD REPLY lost all momentum as a result of the incident, took considerable time to find its feet again, before finishing on fairly. We also accept Mr Williamson’s evidence that he lost 2 lengths as a result of the interference from HEATHER CASTLETON.

The margins were ¾ L and a nose. We are satisfied that the chances of GOLD REPLY were affected as a result of interference from HEATHER CASTLETON and that GOLD REPLY would have finished ahead of HEATHER CASTLETON had the interference not occurred. In these circumstances we exercise our discretion and relegate HEATHER CASTLETON to behind GOLD REPLY.
