FACTS:
Following the running of Race 8, KB’s Express-Cos Ya Hungry Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Mr I R Cameron, alleging a breach of Rule 869 (2) (a) in that Mr Cameron, as the driver of MOTU SPEEDY STAR in the race, “used his whip excessively over the final 400 metres”.
The information was filed with the Registrar on race day and served on Mr Cameron at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on Saturday, 4 December 2010.
Mr Cameron had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information.
Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
SUBMISSION(S):
Mr N R Escott, Chief Stipendiary Steward, showed a video replay of the final 400 metres of the race. He pointed out Mr Cameron, driving MOTU SPEEDY STAR, racing at the rear of the field. Shortly after turning into the home straight, Mr Cameron commenced using his whip and, thereafter, used it on some 25 occasions in the run home. Mr Escott submitted that Mr Cameron’s use of the whip was excessive. The Committee noted that MOTU SPEEDY STAR made no ground in the straight.
REASON(S):
The Committee noted Mr Cameron’s admission of the breach. Further, the Committee was satisfied that to use the whip on 25 occasions in the home straight was “too much” and, clearly, outside the guidelines regarding use of the whip. Mr Cameron had used his whip excessively on this occasion.
DECISION:
The charge was found proved.
SUBMISSION(S) ON PENALTY:
Mr Escott informed the Committee that Mr Cameron had a clear record as far as breaches of the Rule were concerned. He submitted that a fine of $200 was appropriate.
REASONS:
In determining penalty, the Committee had regard to Mr Cameron’s admission of the breach and his previous good record. The Committee also looked at the database of penalties imposed for similar breaches of the rule
PENALTY:
Mr Cameron was fined the sum of $200.
