Following race 7 an information was filed pursuant to Rule 871(3) when it was alleged by the informant, Stipendiary Steward Mr M Williamson, that Mr W Ismail rider of SANDCASTLE committed a breach of that Rule when he made a celebratory gesture prior to the finishing post. 



Following race 7 an information was filed pursuant to Rule 871(3) when it was alleged by the informant, Stipendiary Steward Mr M Williamson, that Mr W Ismail rider of SANDCASTLE committed a breach of that Rule when he made a celebratory gesture prior to the finishing post.

Mr W Ismail admitted the breach and was represented by his employer, Mr J Sargent.

Mr Williamson demonstrated the video films which clearly showed Mr Ismail make a celebratory gesture 2 strides prior to the winning post.  He informed the Committee that it was his first day race riding and his first winner.

Mr Sargent spoke on behalf of Mr Ismail and stated that he was a hard working apprentice and the excitement of winning caused his gesture.

Mr Williamson submitted a $200 fine would be appropriate under the circumstances and reminded Mr Ismail that NZTR had a zero tolerance policy for riders making a celebratory gesture.

PENALTY:

--

The Committee considered all submissions and before imposing penalty considered this was Mr Ismail’s first winning ride, and his guilty plea.  The Committee highlighted to Mr Ismail that we would be imposing a fine of $200 on this occasion, but if he was to re-offend the penalty would be a lot higher.
