Decision:

Following the running of Race 10 an information was filed by Stipendiary Steward Mr J. Muirhead against Mr G.Martin driver of BENROMACH alleging a breach of Rule 869(3) (b)- careless driving , in that he  caused  interference to PRINCESS JILL  and ROXIE HEART the latter losing all chance .

Following the running of Race 10 an information was filed by Stipendiary Steward Mr J. Muirhead against Mr G.Martin driver of BENROMACH alleging a breach of Rule 869(3) (b)- careless driving , in that he  caused  interference to PRINCESS JILL  and ROXIE HEART the latter losing all chance .

Mr Martin admitted the breach and was present at the hearing.

Mr Muirhead demonstrated on the video films  BENROMACH racing into the first bend moving down into the rightful running line of Princess Jill causing interference ,which resulted in Roxie Heart been checked badly , breaking and losing all chance.

Mr Martin said his horse was having its first start as a trotter and proved difficult to handle trotting rough and hanging into the first bend.

PENALTY

--

Mr Muirhead said Mr Martin did not have a good record, with 3 previous breaches of this rule in the last 9 months; they ranged from 2 weeks to 2 months. He suggested a 1 month suspension.
In fixing penalty the Committee takes into account the following.

--

1. The guilty plea- but this was somewhat inevitable.
2. The submissions of Mr Muirhead.
3. The submissions of Mr Martin.
4. Mr Martin’s fair driving record and limited driving opportunities.

--

Balancing those matters the Committee suspends Mr Martins Horseman’s licence starting after racing on September 4 2009 and to conclude after racing on October 1 2009 – effectively 4 weeks
