Following the running of Race 5, EasyLawn (Instant Lawn & Hydro Seeding) Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Mr I R Cameron, alleging a breach of Rule 869 (2) (a), in that Mr Cameron, “as the driver of JASPERS BLUE JEAN used his whip excessively in the run home”.

Following the running of Race 5, EasyLawn (Instant Lawn & Hydro Seeding) Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Mr I R Cameron, alleging a breach of Rule 869 (2) (a), in that Mr Cameron, “as the driver of JASPERS BLUE JEAN used his whip excessively in the run home”.

Mr Cameron had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(2) No horseman shall during any race:-
     (a)  use his whip in an unnecessary, excessive or improper manner
.

Mr Renault showed a video replay of the final stages of the race. He pointed out Mr Cameron on JASPERS BLUE JEAN trailing the leader entering the home straight. He took the passing lane and then used the whip approximately 22 times in the run to the finishing line in a continuous manner with no discernible pauses.

Mr Renault informed the Committee that Mr Cameron had a previous breach of the Rule on 19 May 2009 for which he received a fine of $200. He recommended a fine of $250.

The Committee took into account Mr Cameron’s previous breach and his admission of this breach.

--

Mr Cameron was fined the sum of $250.
