RACEDAY JUDICIAL COMMITTEE DECISION
--Information No: 13971 (Instigating a Protest)
--Meeting: New Zealand Metropolitan Trotting Club
--Date: 26 March 2010
--Venue: Addington Raceway
--Race 3: Coca-Cola Amatil NZ Ltd Handicap Trot
--Rule: 870(4)(a) and “Breaking Horses” Regulations
--Judicial Chairman: J. M. Phelan, Committee: R. G. McKenzie Kms:
--Appearing Informant: Chief Stipendiary Steward Mr N. R. Escott
--Defendant: Mr D. J. Butt (did not attend)
----
DECISION AND REASONS:
----
--
Following the running of Race 3, the Coca-Cola Amatil NZ Ltd Handicap Trot, an information was filed by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 870(4)(a) and the “Breaking Horses” Regulations by the 5th placed horse, “Biddy Bid” (16), driven by Mr D. J. Butt.
----
It was alleged that “Biddy Bid” broke from its gait with more than 50 metres to run, and that it was still in a break at the winning post. Mr Butt, on behalf of the connections of the horse, had endorsed on the Information “I do not contest the protest the horse should be disqualified.
----
Mr Escott used video coverage to illustrate this incident.
----
Accordingly “Biddy Bid” was disqualified from its 5th placing. The amended places are as follows.
----
1st – Vatuvei (17)
--2nd – Jaquimo (9)
--3rd – Dr Hook (10)
--4th – Neville Vaughan (2)
--5th – Sun Of Loose (14)
--6th – Waihemo Jordan (6)
----
After this protest was upheld Mr Escott advised us that the promoted 5th placed horse, “Sun Of Loose” (14), had been in a break when crossing the finishing line, and that it had been lapped on. However no protest was filed because “Sun Of Loose” had broken from its gait due to interference from “Biddy Bid”.
