Following the running of Race 5 an information was lodged by Stipendiary Steward Mr N. G. McIntyre against Mr S. Thompson alleging a breach of Rule 869(2)A in that Mr Thompson used his whip excessively over the concluding stages.

DECISION AND REASONS:

Following the running of Race 5 an information was lodged by Stipendiary Steward Mr N. G. McIntyre against Mr S. Thompson alleging a breach of Rule 869(2)A in that Mr Thompson used his whip excessively over the concluding stages.

Mr Thompson pleaded guilty to this breach at the hearing and was assisted by Open Horseman Mr K. M. Barron.

Stipendiary Steward Mrs K Williams gave evidence by way of video that Mr Thompson was observed to use his whip about 27-29 times for the length of the straight with only brief pauses. This was verified when the film was viewed.

Mr Thompson stated that he hasn?t won a lot of races and had got excited when the finish was so tight. He stated that most of the strikes with the whip were against the sulky shaft and not on the horse. Mr Barron concurred with Mr Thompson's evidence adding that the finish was very tight and he was trying to get the best out of his horse.

PENALTY: Mr Barron advised that Mr Thompson would prefer a fine rather than a suspension as Mr Thompson was a Junior Driver with limited financial means. He asked that the Committee took into account that he had not been charged before under this Rule. Mr McIntyre advised that the Stipendiary Stewards would be recommending a suspension of two driving days.

After a brief adjournment the committee agreed that a two day suspension was justified and Mr Thompson's horseman's licence was suspended up to and including the 8th December 2006.
