An information filed by Stipendiary Steward Mrs K Williams against Mr L Hollis, driver of SHADELANDS SHADOW, alleging a breach of Rule 869(2)(a) in that he used his whip excessively and unnecessarily in the run home.

An information filed by Stipendiary Steward Mrs K Williams against Mr L Hollis, driver of SHADELANDS SHADOW, alleging a breach of Rule 869(2)(a) in that he used his whip excessively and unnecessarily in the run home.

Mr Hollis denied the breach and was present at the hearing.

Mrs Williams showed the video film of the run home.  SHADELANDS SHADOW was last entering the home straight.  Mr Hollis used his whip 21 times in the run home.  SHADELANDS SHADOW finished 7th, 5 lengths behind the 4th horse.  There were 4 stakes bearing places.  Mr Hollis used his whip several times in the concluding stages when his horse had no possible chance of finishing in the first four.  Mr Hollis did not dispute the evidence of Mrs Williams.  He said he had driven his horse aggressively because it did not try when last raced and finished 45 lengths from the winner.  He said on 8 or 9 occasions he did not the horse but hit the shaft or the dust sheet.

DECISIONS AND REASONS:

--

The use of the whip by Mr Hollis was outside of the guidelines issued by the Chief Stipendiary Steward on the 1st June 2009.  21 times in the home straight is “too much”.  Mr Hollis hit the horse with the whip when it was a “beaten runner”.  The charge is proven.  The committee regards the actions of Mr Hollis as one breach of the Rule.

PENALTY:

--

Mrs Williams said Mr Hollis had no breaches of the rules against him in the last 12 months  - the offending was at the upper end of the scale.  She suggested a fine of $250 or a two week suspension.  Mr Hollis asked for the standard penalty – he preferred a suspension to a fine.

In fixing penalty the committee takes into account the following matters:

--

1. The submissions of Mrs Williams
2. The submissions of Mr Hollis
3. The clear driving record of Mr Hollis
4. The offending was towards the upper end of the scale of seriousness
5. The recommended starting point for penalty is a fine of $250 or a 1 week suspension.

Balancing those matters, Mr Hollis’ horsemans licence is suspended for 2 week – effectively 2 days – from the end of racing tonight until the end of racing on the 14th August 2009.
