DECISION AND REASON:
--Stipendiary Steward, Mr CJ Allison, alleged that "racing into the first bend with approximately 2400 metres to run EVERTON STAR (AS Malcolmson) moved inwards when insufficiently clear of JC's STARBUCK (AJ Suddaby).
--Video evidence was shown from 3-4 different angles. In two cases it appeared that Mr Malcolmson was on the back of the leader and that Mr Suddaby appeared to be attempting to push inside. The third view appeared to support Mr Suddaby's claim that he was inside Mr Malcolmson and that Mr Malcolmson had pushed him down onto the markers. (The second view mentioned above was not recovered later when Mr Malcolmson requested it.) The fourth view also supported Mr Suddaby.
--Margins were one and a quarter lengths, a head, a head, with one and three-quarters lengths back to 5th. JC's STARBUCK was 5th and EVERTON STAR 3rd.
--Mr Malcolmson using video claimed he was on the back of the leader and Mr Suddaby was poking up inside him subsequent to this.
--Decision:
--The committee found that the evidence, both oral and video, is inconclusive. Two video angles support Mr Malcolmson and two support Mr Suddaby. Neither one that supports Mr Suddaby shows his position in relation to the markers.
--The committee therefore felt they were unable to reach a clear decision that would enable them to alter the placings of the judge and therefore dismissed the protest.
