Following the running of race 8 the Stipendiary Stewards lodged an information instigating a charge against Mr Bothamley alleging a breach of Rule 871 (1) (d).

DECISION & REASON

--

Following the running of race 8 the Stipendiary Stewards lodged an information instigating a charge against Mr Bothamley alleging a breach of Rule 871 (1) (d).

The information alleges that Mr Bothamley, the rider of ?Moor Park Flyer? allowed his mount to shift inwards when not clear, about 250 metres from the finish causing a check to ?Mr Pins' (Mr G McKeown).

At the outset of the hearing Mr Bothamley confirmed his written advice that the breach was admitted.

The Stipendiary Stewards showed the video evidence of the incident which showed that Mr Bothamley's mount was racing three wide with Mr McKeown's mount on its inside. While progressing forward his horse rolled in and as a result Mr McKeown had to take hold of his mount. The Stipendiary Stewards noted that Mr Bothamley was not his one length clear and another length clear of ?Mr Pins'.

In respect of penalty Mr Ching indicated that credit should be given for his early guilty plea, his good record over the last twelve months and indicated that the offence was at the lower end of the scale but that there was an issue of jockey safety.

Mr Bothamley accepted the Stipendiary Stewards submissions and said that he preferred a suspension.

The Committee after giving consideration to the incident and matters raised in aggregation and mitigation, is of the view that a suspension is appropriate. Accordingly Mr Bothamley's licence to ride is suspended from the completion of racing 21st September 2006 until the completion of racing on 6th October 2006 (an effective 3 days on the information supplied by Mr Bothamley).
